Dhaka The radical Islamic party Jamaat-e-Islami in Bangladesh is struggling to regain its political party status. On Tuesday, Chief Justice of the Supreme Court Syed Mefat Ahmed said during the hearing of the Jamaat-e-Islami petition by the seven-member full appellate bench that this is the country’s first incident when the registration of a party has been canceled through the High Court’s decision.
Tauhidul Islam, who represented the Election Commission (EC) during the hearing, said that the Election Commission has taken back its steps since the High Court intervention in the registration of Jamaat. We are waiting for the decision of the Appellate bench on the registration of the Jamaat. The Representative of the EC told the court that after the administrative decision of the Supreme Court, the Election Commission has removed the Jamaat’s election symbol, scales and if it now needs a new election symbol, it can apply afresh.
According to a report by Bangladesh’s leading daily ‘The Dhaka Tribune’, “The Supreme Court’s Appellate Division has postponed the hearing till 14 May. In August 2013, the High Court settled a writ petition and declared the registration of Jamaat as a political party illegal and zero. After this, in December 2018, the Election Commission, in December 2018, canceled the party’s registration through a gazette notice. Later, Jamaat appealed against the High Court’s verdict, but in November 2023, the appellate division led by the then Chief Justice Obaidul Hasan rejected Jamaat’s appeal as the party’s chief counsel was not present during the hearing of the appeal. As a result, the decision of the High Court to declare Jamaat’s registration as an illegal political party was not effective.
After a violent mass rebellion last year, Jamaat-e-Islami appealed to reconstruct its canceled registration as a political party and regain election symbol scales after Sheikh Hasina-led Awami League government. The Appellate Division of the Supreme Court accepted the request of Jamaat-e-Islami’s re-registration as a political party in October 2024.
On August 1 last year, the previous government led by Awami League banned the Jamaat, its student branch Islamic student camp and all its affiliated organizations as a political unit under the anti-terrorism Act-2009. Muhammad Yunus, who is running the interim government of Bangladesh after Sheikh Hasina’s government, issued a gazette notification, lifted the ban on Jamaat-e-Islami and its student branch. The Jamaat-e-Islami and its student branch had an important role in demolishing Sheikh Hasina’s government.
