The State Consumer Commission has said that leaving the key inside the vehicle is the negligence of the owner, but on the basis of this, the benefit of insurance cannot be completely denied. The Consumer Commission has given this decision in a case of vehicle theft.
The commission rejected outright the demand of the insurance company, which had said that the vehicle was stolen due to the negligence of the insured, hence he was not entitled to get the benefit of insurance. A bench of the Commission’s Chairperson Justice Sangita D. Sehgal and Judicial Member Rajan Sharma disposed of the appeal of the insurance company, modifying the January, 2019 order of the District Consumer Forum.

The company should give 50 percent of the insurance value to the vehicle owner
Amending the decision of the District Consumer Forum, the commission has ordered the insurance company Reliance GIC Limited to pay 50 percent of the insurance value i.e. Rs 8,99,988 to the complainant vehicle owner. The District Consumer Forum had ordered to pay the full amount.
