A bench of Justice DY Chandrachud and Justice Surya Kant granted interim relief by allowing them to attend the state counselling. The bench said in the interim order that till further orders, the petitioner shall not be disturbed in the provisional allotment of one seat in MD Psychiatry course at Topiwala National Medical College, Mumbai. The Supreme Court bench was hearing a petition filed by Iyer Sitharaman Venugopalan.
Senior advocate CS Vaidyanathan, appearing for the petitioner’s counsel Karanjawala & Co, submitted that Venugopalan is a young MBBS doctor and both his eyes are 100% visually impaired. Despite this, he has cleared the NEET PG entrance exam. The bench said that till further orders, the petitioner is being allowed to participate in the ongoing process of counselling.
Earlier, the Bombay High Court, vide its order dated February 2, 2022, had dismissed the petitioner’s interim plea for permission to participate in the NEET counseling process for post graduate medical courses. Subsequently, Venugopalan challenged the order before the Supreme Court. The Court, along with the interim relief, issued notice to the respondents concerned that the petitioner would not be harassed for the interim allotment of seat in MD Psychiatry Course at Topiwala National Medical College, Mumbai.
