The Supreme Court on Wednesday reserved its verdict on petitions seeking 10.5 per cent reservation for Vaniyar community in educational institutions and jobs in Tamil Nadu. Earlier, the Madras High Court had quashed the reservation given to the Vaniyar community. Vaniyars come under the Most Backward Community in Tamil Nadu. A bench of Justices L Nageswara Rao and BR Gavai asked all the parties to file written statements.
The matter was not sent to the larger bench
The Supreme Court had earlier refused to refer the matter to a larger bench. The bench had said that they have gone through the judgment on the matter and are of the view that there is no need to refer the issue to a larger bench. The court was hearing petitions by the State of Tamil Nadu, Pattali Makkal Katchi (PMK), and others. Reservation was divided
The Tamil Nadu Assembly had in February passed the AIADMK party’s bill, which decided to give 10.5 per cent reservation internally to the Vaniyar community. After this, the DMK government issued an order to implement it in July, 2021. Under this, the 20 percent reservation given to the Most Backward Classes (MBCs) was divided into three parts. Of these, 10.5% was earmarked for the Vaniyar community, formerly known as Vanniyakul Kshatriyas.
Madras High Court had overruled the decision
The Madras High Court, while rejecting this reservation, said whether the state government has the right to make internal reservations? The constitution has given sufficient explanation for this. The state government cannot bring any such law.
