“Once the representation is filed, the BMC will hear and decide after six weeks. Once the decision is taken, no coercive action will be taken against the petitioners for three weeks,” the court said. The court further said that the lawyers of the Bachchan family can also be heard personally, if required.

Two notices were issued to the Bachchan family on April 20, 2017, stating that some portions of the plots near their residential property are within the regular line of the street and that the BMC has been asked to construct the bungalow wall and structures for road widening. In this case the Bachchan family had deputed their representatives to appear in the BMC office and inquire about the notice and discuss the matter with the civic authorities and they told the BMC officials that the plots were on the opposite side of the location. It will be easier for the civic body to widen the road.
The petition, filed on behalf of the Bachchan family, said that for a period of four years and nine months, till January 28, 2022, no action was taken by the BMC to implement the notice. In the meantime he accepted that the notice issued had been quashed and hence no formal objection was lodged.
The petition states that on January 28, 2022, some BMC officials verbally informed the Bachchan family that they proposed to implement the impugned notices and would soon acquire a portion of the plots prescribed in the notices. . The petition said that the impugned notice does not take into account the building structures on the plots, which cannot be demolished as per the MMC Act.
The petition claimed that the BMC has not issued any notice to other holders of plots on the same side of the road and no action has been taken by them for widening the stretch of road showing disparity in action.
