New Delhi. The Supreme Court has given a big relief to the consumers and ruled that the Consumer Forum i.e. Consumer Forum can implement all its orders apart from interim. The bench of Supreme Court Justice JK Maheshwari and Justice Rajesh Bindal has said that there was a difference in implementing the orders given by the Consumer Forum due to flaws in the draft of the law in 2002. Now by explaining the law, the Supreme Court made it clear that the order passed by the Consumer Forum between March 15, 2003 and 20 July 2020 will apply like the decree of the Civil Court.
The Supreme Court has said in the judgment that during the 2002 amendment to the Consumer Protection Act, an interim order was written in place of each order. This limited the strength of the consumer forum. Due to which there was a problem in implementing the order given to the consumer forum. The Supreme Court bench said about the mistake made in the law that it was not getting meaningful justice to consumers. The court said that in Section 25 of the 1986 Act, it should be read as approval for enforcement of any order. So that its original position can be restored. The Supreme Court said that consumers should realize that justice has been found in reality, not just in paper.
The case, which came to the Supreme Court, was related to people taking flat in Pune’s Pam Groves Co-operative Housing Society. The District Consumer Forum had directed the builder of the flat in 2007 to dedicate the convene in favor of the society, but the Bombay High Court quoted the consumer forum by citing the 2002 law amendment. After this the matter reached the Supreme Court and issued an order to provide justice to the flat buyers. Not only flat, now the consumer who buy any goods will benefit from the latest decision from the Supreme Court.
