The Supreme Court on Thursday refused to hear the petition challenging the notification issued by the Municipal Corporation of Delhi (MCD) regarding raising stray dogs.
Justice J. Of. A bench of Maheshwari and Justice Vijay Bishnoi refused immediate hearing after a lawyer referred to the application in this regard.
The application stated that the MCD issued a notification despite the Supreme Court reserved the order.
On August 14, the court had said that the entire problem of stray dogs in the Delhi-National Capital Region (NCR) is due to the “inactivity” of local authorities, keeping its order on an interim application requested to stay the instructions of August 11 passed by the apex court.
Three judges-Justice Vikram Nath, Justice Sandeep Mehta and Justice N. The bench of V. Anjaria reserved its order in the case.
Justice J. B. Pardiwala and Justice R.K. A bench of two-judges of Mahadevan on August 11 directed Delhi-NCR officials to “start raising stray dogs from all areas” as soon as possible and transfer them to dog shelter sites made for dogs.
The bench had directed the authorities to immediately make a shelter site for dogs and report about the construction of such infrastructure within eight weeks.
The bench had said that stray dogs would be kept in shelter sites and would not be left in roads, colonies or public places.
The apex court on August 11 issued several instructions during the hearing of a case launched on July 28, taking automatic cognizance of rabies, especially from the bite of stray dogs in the national capital.
