This minor girl had sought permission from the Supreme Court to terminate her 28 weeks (7 months) pregnancy. In such a situation, the bench of CJI DY Chandrachud in the Supreme Court, while hearing the petition of the victim, allowed her to have an abortion.
A bench headed by CJI Chandrachud rejected the Bombay High Court’s decision to refuse to order abortion. The Supreme Court gave the order using the power given under Article 142. CJI Chandrachud said in his order that every hour of delay in abortion is full of difficulty for the child.
