Mumbai. The Bombay High Court has refused to grant bail to an accused accused of repeatedly raping a minor girl, saying that this crime is not only shocking to the conscience of any rational person but is also disgusting. The accused raped the victim since she was 10 years old.
A single bench of Justice Prithviraj Chavan on Monday rejected the bail plea of the accused, saying that this crime is not only shocking to the conscience of any sane person but is also disgusting.
In its order, the High Court also quoted the 27-page diary written by the victim in which the girl had narrated her ordeal. The court said that words would fall short to describe the mental, psychological and physical condition of the victim and the impact of the brutality inflicted on her by the accused.
The victim’s parents claimed that the accused and his wife took advantage of the fact that the girl’s father worked in Dubai. He claimed that he came to know about the crime when he found the victim’s diary in her room in 2021. She was 17 years old at that time. The girl had eloped with a boy, after which her parents searched her room.
In the diary, the victim claimed that the accused had started raping her when she was in the fourth class and his wife was aware of it. She had claimed that the accused used to give her a medicine to sexually excite her. The bench also mentioned this in its decision.
After seeing the diary, the girl’s parents lodged a police complaint against the accused and his wife in 2021. The wife was granted bail by the special court, but the bail plea of the accused was rejected, after which he approached the High Court for bail.
