The state government had filed a criminal confirmation case in the High Court under CrPC for the death row convicts. As per Section 366 of CrPC, the sentence of death is not commuted unless it is confirmed by the High Court in case the sentence has been awarded by the Sessions Court. Also, as per Section 368 of CrPC, the High Court cannot confirm the sentence or acquit the persons, or dispose of the appeal, before the expiry of the time limit for allowing appeals.
Public Prosecutor Mitesh Amin said that the court has issued notices to 38 convicts who came back on June 9. The court will hear the confirmation case only if the convicts do not appeal the sentence before that time. They are allowed 90 days to file an appeal. On 26 July 2008, 22 bomb blasts took place in different parts of Ahmedabad city. Police had claimed that people belonging to the Indian Mujahideen (IM), a faction of the banned Students Islamic Movement of India (SIMI), were involved in the blasts.
