The decision to remove loudspeakers from religious places in Uttar Pradesh has also been approved by the High Court. Allahabad High Court has said that azaan on loudspeaker is not a fundamental right. With this important remark, the court has dismissed the petition filed by a Maulvi of Badaun. This decision of the court has come at a time when on the orders of the Yogi government, more than one lakh loudspeakers have been removed from religious places in UP and the sound of more than this has been reduced.
The petition filed by Mutawalli Irfan of Noori Masjid of Badaun was dismissed by the bench of Justice Vivek Kumar Birla and Justice Vikas Badhwar. Irfan had applied to SDM Tehsil Bisoli, seeking permission to install loudspeakers for Azaan. After the SDM rejected it, Irfan had approached the High Court.
Irfan had demanded from the court that the government and the administration should be directed to allow the installation of loudspeakers / mics in the mosque. He also argued that the SDM’s decision is illegal and violates his fundamental rights. Rejecting Irfan’s arguments, the court said that the law has been decided that the use of loudspeakers at the mosque is not a fundamental right. The court dismissed the petition, rejecting Irfan’s arguments.
