New Delhi. Bharatiya Janata Party leader and former Rajya Sabha MP Subramanian Swamy has received a setback from the Delhi High Court. The court, while disposing of the petition filed by Swamy on Wednesday, has ordered that he (Subramanian Swamy) vacate his government bungalow in Delhi within 6 weeks. Regarding the matter, it has been said on behalf of Delhi High that this government bungalow was allotted to Subramanian Swamy for 5 years, whose period has expired. In such a situation, the owner should vacate the bungalow.
The demand was made by the owner by filing a petition.
Subramanian Swamy had filed a petition in the Delhi High Court seeking extension of the period of stay in the bungalow where he is staying. Let us tell you, Swamy was living in this government bungalow since January 2016. He had demanded that the bungalow be re-allocated to him, keeping in view the security threat. However, while hearing the petition, the court shocked Swamy and said, ‘The allotment was made for five years and that period has expired. Nothing was placed before the court which makes it mandatory for allotment of government accommodation to a person having Z category security also.
Jain states that @Swamy39 has a nice house in Nizamuddin East and can shift there.
Mehta for @Swamy39 argues that my Security has not gone down. My Lord!
Only, if MHA ensures that they will do everything desired to help for shifting, safety & security, then i can shift.— LawBeat (@LawBeatInd) September 14, 2022
period expired in 2022
In January 2016, the bungalow was allotted to Swami by the Center for 5 years. Swamy lived in the same bungalow during his entire Rajya Sabha tenure. Now when this time period ended in April 2022, according to the rules, they had to vacate the bungalow. However, Swamy took the decision of approaching the Delhi High Court. Swamy had demanded re-allotment of the bungalow in view of the security concerns. Although he has been ordered to vacate the bungalow, he has been given Z category security by the Centre.
Swami’s lawyer put this argument
Speaking on behalf of the Centre, Additional Solicitor General (SG) Sanjay Jain, speaking on Swamy’s appeal, said that it would not be possible to allot the bungalow again. Swami may shift to his Delhi residence. During this, the security agencies will take all possible steps to ensure their safety there. On this point of Sanjay Jain, senior advocate Jayant Mehta, appearing for Swamy, argued that there is no problem for Swamy to stay in that Delhi house but the need of the house to accommodate the security personnel who were accompanying him. Is. He said, ‘Till today the number of guards has not reduced, I have no problem going to my private residence but it is insufficient for the security personnel. As a security person, I have to ensure that they (security personnel) can also rest and their basic needs are met.
