New Delhi: A hearing was held today in the Supreme Court on the bail plea of Jharkhand Mukti Morcha (JMM) leader Hemant Soren, arrested in the alleged land scam. The biggest question is that like Delhi Chief Minister Arvind Kejriwal, will former Jharkhand Chief Minister Hemant Soren also get interim bail to participate in the election campaign? Let us tell you that the vacation bench of Justice Dipankar Dutt and Satish Chandra Sharma is hearing this case. During the hearing, a heated argument was seen between ASG SV Raju and Kapil Sibal.
On behalf of ED, ASG SV Raju said that Soren cannot demand bail citing the relief given to Kejriwal. The facts are different in both the cases. Soren was arrested before the elections. Then in this case, the court has taken cognizance of the charge sheet against Soren, that is, the lower court had prima facie accepted the case against him. He did not challenge this order anywhere. Not only this, Soren’s bail application has also been rejected.

Why did Sibal object?
During the debate, ASG Raju from ED’s side was interrupting. Lawyer Kapil Sibal from Hemant Soren’s side objected. The court also said that you will get a chance to speak. ASG Raju further said in the argument that he wants to make one thing clear that here the court has taken cognizance. This is the difference in this case. He had also filed a bail.
ASG Raju further said that the bail was rejected and he was not arrested a few days before the announcement of elections. The court took cognizance after getting a prima facie case against Hemant Soren. He filed bail on 15 April. Which was rejected on 13 May. This is different from the Kejriwal case. At the same time, the Supreme Court said that we have to be satisfied whether the arrest can be challenged even after the court takes cognizance. Praveer Purkayastha’s case was different, in that the grounds for arrest were not given.
