new Delhi. The Central Bureau of Investigation (CBI) has registered a new case in the alleged Rs 1,200 crore subsidy scam in 2000. The Allahabad High Court had observed that the investigation in the matter was not conducted properly and it required a thorough investigation.
The federal investigative agency will file a progress report in the case on March 21.
In 2000, Rock Phosphate was supplied by Ujjwal Trading Company, Jhansi to Madan Mahadev Fertilizers & Chemicals Pvt Ltd. The subsidy was available from the Agriculture Department of the UP government. However, it was later found that the rock phosphate was never supplied and the entire amount was embezzled.
The scam was detected by the UP government in 2000 after which the Agriculture Department launched an investigation and it was found that during the financial years 1998-99 and 1999-2000, 3,396.025 MT of Rock Phosphate and 6080.32 MT of Single Super Phosphate were sold and purchased. Madan Madhav Fertilizers & Chemicals Pvt Ltd’s claim was false.
The embezzlement of Rs 48,18,243 and the subsidy claimed from the government were found to be false.
After this, the UP Police had registered a case against 20 accused including firms in 2004.
In 2019, the UP Police had filed a charge sheet against only two accused. Later in this case in 2021 supplementary charge sheet was also filed against three people and a clean chit was given to Mahadev Fertilizers & Chemicals Ltd. But the court was not satisfied with the investigation.
The Allahabad High Court had noted, “Mahadev Fertilizers and Chemicals Ltd. was given a clean chit in the case, but it was not shown how and under what circumstances the clean chit was given and what happened to the remaining Rs 1,152 crore. The investigation appeared to be faulty.” and further investigation in the matter is required to be comprehensive.”
The counsel for Ujjwal Trading Company, Jhansi, which supplied rock material to Madan Mahadev Fertilizers & Chemicals Pvt Ltd, argued that the actual owner of the company was Ashutosh Kumar Modi, not Avinash Kumar Modi (his brother). The firm was closed in 1995 but Yun Modi, his CA, kept the firm alive on paper and transacted without the permission of the actual owner and thus the owner and his brother were innocent.
Now the Federal Investigation Agency has formed a team to prepare the answer, which will be filed on March 21.
