Bilaspur. Chhattisgarh High Court News: Hearing the contempt petition of the retired soldier, the Single Bench of the High Court has issued a contempt notice to Bilaspur Collector Dr. The petitioner has appealed for allotment of land, alleging violation of the order of the High Court. Retired soldier Dinesh Jaiswal, a resident of village Khaira in Bilaspur district, has filed a petition in the Chhattisgarh High Court through advocate Abhishek Pandey, saying that he has retired from the post of constable in the Army on August 31, 2015.
On August 9, 2015, Secretary Revenue Department, Government of Madhya Pradesh and on 25 January 2021, Secretary Revenue Department, Government of Chhattisgarh have issued circular regarding allotment of land to ex-servicemen. In which provision was made that non-commissioned ex-servicemen who are landless would be allotted five acres of unirrigated or two and a half acres of irrigated land in their residence district. According to the petition, a representation was submitted before the Collector Bilaspur for allotment of land under the provisions of the state government. Due to non-disposition of the representation, the retired soldier had filed a writ petition in the High Court. Accepting the petition, the High Court had issued directions to Collector Bilaspur to allot land in compliance with the provisions of the Madhya Pradesh and Chhattisgarh governments.
The court had asked the petitioner to present a representation before the collector. Following the directions of the High Court, the petitioner presented a representation for the allotment of land before the Collector Bilaspur. The collector has not disposed of the representation till date. Along with the representation, the petitioner had also produced a copy of the directions of the High Court. For not following the directions of the High Court, the petitioner, through his lawyer, has filed a contempt petition against the Collector Bilaspur, alleging that he has disobeyed the court order. In the petition filed, Collector Bilaspur has complained about not taking action even after the order of the court. The matter was heard in a single bench of Justice RCS Samant. After hearing the case, Justice Samant issued a notice to the Collector Bilaspur and directed him to present his reply.
