The court reduced the fine of 1 lakh of the food department to 35 thousand. The fine of the food department was considered against the rules. The milk trader had appealed against the order of the food department in the district court.
The facts of the case in a nutshell are as follows: Food Safety Officer Akhilesh Singh Gangwal on 29th September 2016 at 01.30 PM at the firm Shivani Milk Dairy, Opposite Gurdwara, A.B. Road, Mohana. The person present on the occasion got his introduction by making him aware of his post introduction. Describing his name as Ramniwas Singh Rawat, he identified himself to be the partner of the dairy and the other partner’s name as Umaid Singh. During inspection, it was found that there was no board on the shop and about 800 liters of milk were filled in three drums. A cream dispenser was installed, through which the work of extracting cream was being done. 20 kilograms of cream was kept in two tins. Which were found stored for manufacture and sale etc. for human consumption. When asked, the milk was told to be skimmed milk. When he doubted the quality of both the food items, he expressed his desire to take samples of skimmed milk and cream for standard level test and filled the information in Form 5A. On the spot, after paying a total of Rs 320 in cash at the rate of the market price of the samples, he got the sales receipt for the sample, after weighing two liters of milk with the help of scales, took it in a clean vessel and took 1 kg of keem in a clean vessel and in both. After mixing formalin, four equal parts of both the samples were taken four clean, dry, clean.
