Delhi High Court on Tuesday directed to remove alleged derogatory material against BJP spokesperson and senior advocate Gaurav Bhatia from social media platforms. These posts were made on social media in connection with the incident of scuffle with Bhatia in a Noida court on March 20. The High Court said that public criticism and alleged derogatory posts on social media platforms have increased a lot, but personal dignity and respect cannot be allowed to be hurt on the basis of the right to freedom of expression.
The court passed the order on Bhatia’s application to grant interim relief by removing the derogatory posts from social media platforms. Justice Neena Bansal Krishna condemned the incident of scuffle and said that the lawyers might have been on strike in the Gautam Buddha Nagar court, but when the petitioner Bhatia got information about this, he agreed to the adjournment, which was allowed.
The High Court said, “Under the circumstances, manhandling him, as stated in his complaint, is a highly condemnable act done to him.” The court said that it is the duty of the press and media to report the incident. , but there is also a duty to remain truthful about the incident. The court said that the ‘deepfake’ video showing Bhatia being beaten is nothing but an ultra-sensationalization of patently false facts.
The court said that the circulation of such videos has not only damaged his reputation but is also likely to pose a threat that it may be circulated and used against him in the future. The court said that till the case is decided, there can be a ban on making the material public. This suit has been filed against YouTube channels and ‘X’ handle.
