New Delhi. While on one hand the Shraddha murder case shook the whole country, on the other hand the discussion about live-in relationship increased. The reason is that Shraddha and Aftab are in a relationship. Although Shraddha’s father had objections to this relationship, Shraddha left her home saying that I am now 25 years old, so I can take decisions in my own interest. At the same time, this whole matter has also raised questions regarding parenting. After living together for three years, when Shraddha asked Aftab to marry him, he not only refused, but also behaved inhumanly with Shraddha. The hallmark of which we got to see in the past in the form of a viral picture on social media, in which the bruises on Shraddha’s face were telling Aftab’s cruelty.
Pay attention… Shraddha and Aftab started living in the year 2019. And in the year 2020 itself, Aftab was determined to cross the limits of his cruelty which would clearly show that he had never loved Shraddha but her body. Not only this, some media reports have even claimed that for the happiness of his daughter, Shraddha’s father had agreed to get her married to Aftab, but Aftab’s family did not agree to it. Once when Shraddha’s father went to Aftab’s house to talk about this issue, he was also treated indecently.
The cruelty of this past season had reached its peak. At the same time, Shraddha used to tell her mother on the phone about the brutality being done by Aftab. On which her mother used to ask her to come home, but she did not go home for fear of what people would say. However, when her mother passed away, she went to her home, after which she came back to Aftab and again a series of fights started between the two.
On May 17, when Shraddha again proposed marriage to Aftab, Aftab strangled her. After which he died. Aftab cut Shraddha’s body into 35 pieces and threw it in the Mehrauli forests to dispose of Shraddha’s body after death. The police has started looking for him. So far the police have found 13 bones. On the other hand, after this whole matter, the discussion about live-in relationship is at its peak across the country. Everyone is expressing their opinion on this. Some are opposing it, some are supporting it. In the year 2018, a survey was done regarding live in. In which it was revealed that 80 percent people supported live in and 20 percent opposed it. Everyone had their own arguments.
Is it a crime to live in?
On the other hand, after the Shraddha murder case, questions are being raised whether living in live-in is a crime, so see if there is any such provision in the law that living in live-in is a crime. Don’t know how many such people are there in the country, who live in live-in with mutual consent. Not only this, the Supreme Court had made a comment 16 years ago. In which the court said that any adult couple can live in live-in with mutual consent. It is not in the category of crime, nor have any legal provisions been made regarding it.
Some people may find it wrong, but the court has considered it moral. If a person lives in live-in without divorce, then he will be included in the category of crime. Last year, the Punjab-Haryana High Court had also said in its comment that living in live-in is not a crime. Any number of adults can voluntarily live together under one roof.
Rights given to women in live in
According to the National Family Health Survey, 16 percent of women living in live-in are victims of sexual violence by their partners. If the women living in live-in leave their partner, then they too have the right to get alimony like married women. Under Section 125 of IPC, women living in live-in have also been given the right to pay alimony. Not only this, psychiatrists themselves have accepted the fact that men living in live-in become more cruel and gradually lose interest in their partner.
right to ancestral property
If a couple living in Lin Inn had a child, he would have full rights in his father’s property. In this context, the Supreme Court had given an important decision in the past. In fact, a woman living in a live-in had asked the court for equal property rights for her child in the father’s property. When the matter first reached the Kerala High Court, the court refused. After which the matter reached the Supreme Court, the Supreme Court reversed the decision of the High Court and gave the decision to give equal property to the child of the woman.
Some have bent on telling it right, and some wrong. On the other hand, if we talk about the police action in the Shraddha case, then the court has approved the polygraph test of the accused Aftab, so now his polygraph test will be done before the narco test, so that the truth of the matter can be revealed, because Aftab police Not cooperating with enquiry. Now in such a situation, what direction will this whole matter take in the coming days. Everyone’s eyes will be fixed on this.
