New Delhi. The Supreme Court on Tuesday issued a notice on the controversial statement of the President of ‘Indian Medical Association’ (IMA) and sought his reply by May 14. In fact, Acharya Balkrishna filed an application in the Supreme Court saying that IMA Chief Dr. R.V. The deliberate statements made by Ashokan are a direct interference in the instant proceedings and interfere with the process of justice. He described Ashokan’s statement as condemnable in nature and said that this comment is a clear attempt to lower the dignity of this honorable court and the majesty of law in the eyes of the public.
In his petition, Balakrishna has demanded action against Ashokan as per law. While talking to a news agency, IMA President Ashokan had said that it is very unfortunate that the Supreme Court criticized the practice of IMA and private doctors. He had said that some statements of the apex court have lowered the morale of private doctors and we feel that they should have seen what information has been placed before them.
To prevent misleading advertisements, the Supreme Court also said during the hearing that eminent and public figures should behave responsibly while endorsing a product. The top court directed that before allowing any advertisement to be released, a self-declaration form should be obtained from the advertisers as per the ‘Cable Television Network Rules, 1994’. Rule 7 of this law of 1994 provides for an advertising code, which states that advertisements should be made in accordance with the laws of the country.
A bench of Justices Hima Kohli and Ehsanuddin Amanullah also asked the concerned central ministries to apprise it of the misleading advertisements and the action taken or proposed by the Central Consumer Protection Authority (CCPA). The bench said, “Endorsement by celebrities, ‘influencers’ and public figures helps a lot in promoting products and they are liable to be held accountable while endorsing any product and while advertising it.” It is mandatory to work with.”
The apex court is hearing the case related to misleading advertisements by Patanjali Ayurveda Limited. The court is hearing a petition filed in 2022 by the ‘Indian Medical Association’ (IMA), alleging that Patanjali and yoga guru Ramdev launched a campaign to defame Covid vaccination and modern systems of medicine. The bench has criticized the misleading advertisements about Patanjali’s products. These advertisements have now been banned, but they are still available on various internet channels.
