New Delhi. If a young man commits suicide after failing in love, is the woman responsible for it? A similar case came up in Delhi High Court. While granting anticipatory bail in a case of abetment, the High Court said that if a man ends his life due to failure in love, a woman cannot be held responsible. The court said that no other person can be blamed for the wrong decision taken by a person of weak mentality.
The bench of Justice Amit Mahajan said, ‘If a lover commits suicide because of failure in love, if a student commits suicide because of his poor performance in the examination, if a client commits suicide because his case has been rejected. In such cases, the woman cannot be held guilty of instigating the examining attorney. In the present case, the woman and one of her friends are facing legal action on charges of instigating a youth to commit suicide in 2023.
A suicide note has been found in which the deceased has said that he is committing suicide because of two applicants. The High Court said that it was true that the deceased had mentioned the names of the applicants in his suicide note, but it was of the opinion that there was nothing in the note to show that the threats were of such a dangerous nature that the person committing suicide would be a “ Ordinary person”.
It said, “Prima facie, the alleged suicide note only expresses the anguish of the deceased towards the applicants, but it cannot be inferred that the applicants had any intention due to which the deceased committed suicide.” The court said that from the WhatsApp chats placed on record, prima facie it appears that the deceased was of sensitive nature and he would continuously threaten the woman that he would commit suicide whenever she refused to talk to him.
The court, while granting anticipatory bail to the applicants, said that the purpose of custodial interrogation is to assist the investigation and is not punitive, adding that there is no need for custodial interrogation of the two applicants. It directed the applicants to join the investigation and cooperate in the investigation. The court said that the state would be free to file a petition seeking cancellation of bail in case of any violation of bail conditions by him.
