Patna. Patna High Court has given a big blow to Nitish Kumar government of Bihar. Patna High Court has cancelled the order of Nitish Kumar government to increase the reservation of backward caste, extremely backward caste, SC and ST from 50 to 65 percent in Bihar. CM Nitish Kumar’s government had passed a bill in the assembly after conducting a caste survey and issued an order to increase the reservation. It is believed that the Bihar government will now challenge this decision in the Supreme Court.

When Bihar CM Nitish Kumar had conducted the caste survey, he was running a Mahagathbandhan government in the state with RJD and Congress. The caste survey was done in a hurry and its data was released. Only after this, Nitish Kumar’s government had issued an order to increase the reservation of backward, extremely backward, SC and ST to 65 percent. At that time it seemed that this decision of the government would not stand in the court. The main reason for this is that the Supreme Court has fixed the limit of reservation at 50 percent. Now the Patna High Court has also cancelled CM Nitish Kumar’s order to increase the reservation.
Earlier, when Nitish Kumar’s government had decided to conduct a caste survey in Bihar, it was also challenged in the Patna High Court and the Supreme Court. Those who filed a petition against the caste survey argued that census is a central matter and the state government cannot do it, but the Patna High Court and the Supreme Court did not consider it a census and ordered it to continue. Let us tell you that all the opposition parties have been constantly demanding from the Modi government to conduct a caste census, but the central government has never given any statement in its favor.
