Union Home Minister Amit Shah introduced the 130th Constitution Amendment Bill in the monsoon session of Parliament on Wednesday (August 20), which has been sent to the Joint Parliamentary Committee (JPC). The main objective of the Constitution Amendment Bill, 2025 is that if a Union Minister, Chief Minister of a state or Chief Minister of Union Territory is found accused in any criminal case, he will have to resign from his post immediately. However, this bill introduced by the Union Minister is being strongly opposed by the opposition. But, now the government has started saying that even if the bill is not passed, it has no problem.
Why is the government not worried about not passing the bill?
The government seems to be worried about the bill removed from the post after the arrest of the Prime Minister, Union Minister, Chief Minister or Minister of any state. Actually, the clear purpose behind this bill is to put the opposition in the dock. The government wants to give a clear message by opposing this bill that the opposition parties want to run the government or ministry from jail. That is, the government was already ready that this bill will be sent to the Joint Parliamentary Committee. The government had decided that if there is no consensus on it, then the opposition will have to answer why they are reluctant to the issue of morality in politics.
Amit Shah surrounds the opposition on the issue of morality in politics
Union Home Minister Amit Shah has attacked the opposition through social media over opposition to this bill. He posted several posts on the social media platform x. He wrote in the post, ‘In view of the Modi government’s commitment and public anger against political corruption in the country, I introduced the Constitution Amendment Bill in Parliament with the consent of the Lok Sabha Speaker, so that important constitutional posts, such as Prime Minister, Chief Minister, Central and State Governments Ministers, could not run the government while in jail.’
Amit Shah said that the purpose of this bill is to raise the declining level of morality in public life and bring conflict into politics. The law that will come into existence from these three bills is that no person will be able to rule the Prime Minister, Chief Minister, Central or State Government by being arrested from jail. When the constitution was formed, our Constitution makers did not even imagine that there would be political persons in future who would not resign on the basis of moral values before they are arrested. In the last few years, such a surprising situation arose in the country that the Chief Minister or the minister continued to run the government immorally from jail without resignation.
The Union Home Minister wrote, ‘This bill also provides for bail from the court to the accused politician within 30 days of arrest. If they do not get bail within 30 days, then the Prime Minister at the Center and the Chief Minister at the Center will remove them from their posts, or they will be disqualified legally to function themselves. If such a leader gets bail after the legal process, he may re -hold his post. Now the people of the country will have to decide whether it is appropriate to run a government by staying in jail for a minister, Chief Minister or Prime Minister?
Accused of running a government from jail and not giving up the craze for power
Amit Shah wrote in his second post, ‘On the one hand Prime Minister Narendra Modi has presented a constitution amendment to bring himself under the purview of law, on the other hand, the entire opposition under the Congress leadership has opposed it by being out of the purview of the law, by accusing him of running a government from jail and not giving up power. The country also remembers the time when the then Prime Minister Indira Gandhi gave such a privilege to the Prime Minister through the Constitution Amendment No. 39 in this great house that no legal action could be taken against the Prime Minister. On the one hand, the Congress’ work culture and policy is that they amend the Constitution and make the Prime Minister above the law. On the other hand, the policy of the Bharatiya Janata Party is that we are bringing the Prime Minister, ministers and chief ministers of our government under the purview of the law.
