The first bench of the Madras High Court on Thursday wondered why the Constitution should not be rewritten to provide 7.5 per cent reservation in medical courses only to government school students. The bench said, the Constitution would need to be rewritten to provide for educational institution based reservation. Now the matter will be heard on March 17.
The observation was made orally by a bench of Chief Justice MN Bhandari and Justice D Bharat Chakraborty while hearing PILs challenging a law of the previous AIADMK government to give reservation to government school students.
In some petitions, the validity of this provision was questioned, while in some petitions it was said to give its benefit to the students. In some petitions, there was a demand to include private and minority institutions also under the purview of reservation.
