Whose election symbol is, this decision is taken by the Election Commission under ‘The Election Symbols (Reservation and Allotment) Order 1968’.
– In paragraph 15 of this order, the rules for giving election symbol or transferring it to someone else are written.
When the election symbol dispute reaches the commission, the commission looks into the vertical division in the party. That is, it is seen who is stronger in the number of MLAs-MPs and in the number of leaders of the organization.
The Election Commission asks for the list of party committees etc. from both the parties for the division and it should also have the signatures of the supporters of both the parties.
If the Election Commission is not satisfied, then it freezes the election symbol of the party and then allots new names and symbols to all the parties till the decision is taken.
With Shiv Sena rebel Eknath Shinde, 40 MLAs have the support now. There is talk of being with some MPs as well. Yet he still does not have the majority of the office bearers of the party.
Shinde still needs the support of all the units including the deputy leader, general secretary, spokesperson, MP, MLC, mayor and deputy mayor of Shiv Sena, including youth organization, women’s organization. Overall this support needs to be more than half.
That is, Uddhav Thackeray is not in danger of losing the election symbol at the moment. Now all the leaders of the organization are standing with him. If he can keep the office bearers with him in future also, then Shinde may have to face his face.
