Mumbai. The Maharashtra government on Tuesday informed the Bombay High Court that it has withdrawn its order to demolish the illegal construction in the bungalow owned by Union MSME Minister Narayan Rane. Advocate General Ashutosh Kumbhakoni, Justice A.A. Saeed and M.S. The division bench of Karnik was apprised of the stand of the state government.
The statement came after a petition was filed against the Collector’s March 21 order ordering Rane to remove the alleged unauthorized construction carried out in the bungalow and said the authorities concerned would demolish it if not removed.
Kumbhakoni also said that the government would consider any application by Rane to regularize the alleged illegalities before taking action in the matter and the court gave the state liberty to initiate any fresh action as required by law.
Even a major fight broke out between the Maha Vikas Aghadi government and the opposition Bharatiya Janata Party, as Rane challenged the collector’s order citing various grounds.
No show cause notice was given before the order and no reply was sought. No hearing was held before the order was passed, it was arbitrary and without jurisdiction or powers. This was a violation of the fundamental rights of the petitioner.
Following the arguments of the state government, the High Court disposed of Rane’s petition.
