The Allahabad High Court has held that a married woman is very possessive towards her husband. She cannot share it with anyone. Making such remarks, the High Court recently dismissed the petition of a person against the order of the lower court seeking acquittal of himself from the charge of abetment to suicide. The man’s wife had allegedly committed suicide because her husband had married another woman without divorcing her.
A bench of Justice Rahul Chaturvedi dismissed her revision petition holding that the Indian woman cannot share her husband at any cost. The court said that it would be the biggest blow to any married woman that her husband is being shared with another woman or he is going to marry with another woman. In such a situation, no understanding can be expected from him. This is what happened in this case when the woman committed suicide after finding out that her husband had secretly married another woman.
what was the matter
In September 2018, the wife of accused Sushil Kumar had lodged an FIR against him and all the family members under sections 323, 494, 504, 506, 379 of the IPC. The woman had alleged that the accused was already married with another woman. He has two children from that marriage. After this he got married for the third time without giving divorce. The woman also accused the accused and his family members of assault, misbehavior and abusing her. When the accused left her and kept a new woman in his house, the woman decided to register an FIR and soon thereafter committed suicide by consuming poisonous substance.
The accused accepted the third marriage
The High Court said that the accused has admitted that he had married for the third time in September 2018. The court held that the husband’s third marriage was the only reason behind the woman’s decision to commit suicide. Simultaneously, the High Court dismissed the revision petition of the accused.
