A court in Assam’s Barpeta district on Friday (April 29, 2022) granted bail to Gujarat MLA Jignesh Mevani in a case related to an alleged “assault” on a woman police officer. The court also pulled up the state police for registering a “false FIR” during this period.
Barpeta District and Sessions Judge Aparesh Chakraborty, while hearing the bail petition, referred to police encounters in the last one year. It also urged the Gauhati High Court to direct the state police force to “reform itself”.
According to the court, the allegation of intent to outrage the modesty of a woman police officer in the presence of two other police officers cannot be leveled against the accused when he was in their custody and was not seen by anyone.
The judge said that the High Court may consider directing the Assam Police to “reform themselves to register a false FIR as in the present case and to prevent the police personnel from shooting and killing or injuring the accused, who It has become a regular occurrence in the state.
The order further states that the High Court shall require every police personnel engaged in law and order duty to “wear a body camera, while arresting an accused or transporting an accused to any place for goods or other reasons”. It may also consider directing installation of CCTV cameras, installation of CCTV cameras inside all police stations.” It also said, “Otherwise our state will become a police state (police state) which the society cannot tolerate.” .”
The Court also directed that the order be placed before the Registrar General of the Court for placing it before the Chief Justice and he may look into this aspect and consider whether the matter should be referred to as the “Police issued in the State”. Can be taken as a Public Interest Litigation (PIL) to put a stop to the excesses.
In the case registered at Barpeta Road police station, Jignesh Mevani was granted bail on a personal bond of one thousand rupees. In fact, Mevani was arrested on Monday for allegedly assaulting a woman police officer when she was being brought to Kokrajhar from Guwahati by a police team.
