Taking a very soft stand on the appeal of MP Sharad Yadav, who merged his party with RJD, the Supreme Court has urged the Center to consider his appeal sympathetically. The central government had informed the apex court that there was a shortage of government accommodation in Delhi and Pashupati Nath Paras was waiting for the bungalow to be vacated.
A bench of Justices DY Chandrachud and Surya Kant said that it does not want to get into the politics of the matter, but is looking to resolve the matter purely from humanitarian point of view. The court on Monday asked the central government to tell how reasonable time can be given to former Union minister Sharad Yadav to vacate the government bungalow on humanitarian grounds. He is treating many diseases. The top court told Yadav that he would have to give an affidavit that he would vacate the government bungalow on the stipulated date. Asked ASG Sanjay Jain, appearing for the Centre, to bring instructions from the Center as to how much time Sharad Yadav can be given.
Kapil Sibal, appearing for Sharad Yadav, said that his term is ending in July. He is ready to give an affidavit that he will vacate the bungalow by that time. Sibal said that Shadar Yadav has to undergo dialysis everyday. He was put on ventilator during COVID. He is suffering from various types of diseases. He said that he is not saying that he will not vacate the bungalow but he should be given some time for this.
ASG Sanjay Jain said that there is a shortage of government accommodation in the capital. After the expansion of the cabinet, there is a need to give bungalows to many ministers. He said that Sharad Yadav has been disqualified from the Rajya Sabha. His writ petition regarding disqualification is pending for adjudication. Jain said that Sharad Yadav has now merged his party with the Rashtriya Janata Dal to keep the bungalow with him.
