New Delhi: A PIL has been filed in the Delhi High Court in the Swati Maliwal case. Chief Minister Arvind Kejriwal’s close aide Bibhav Kumar is accused of assaulting Swati Maliwal. This PIL was filed to stop the media from broadcasting the name of AAP’s Rajya Sabha MP Swati Maliwal. On Friday, the Delhi High Court expressed displeasure over the lawyer who filed this PIL.
The Delhi High Court said that this petition has been filed only for ‘publicity’. Political color is visible in it. The court said that when the ‘victim’ (Swati Maliwal) herself is coming forward and talking about the alleged incident, then what problem does the petitioner, who is a third party, have. The bench of Acting Chief Justice Manmohan and Justice Manmeet P.S. Arora said, ‘When the victim herself wants to talk about this, then who are you to say anything. The victim is not complaining, but you are complaining. What is the role of the third party in this? The victim is coming out openly about this. It is very clear that your vision is blurred and there is some other color in it. You are not talking about the embarrassment of the victim.’
‘Who are you?’
The High Court said, ‘If the victim is talking on television channels, then who are you to file a PIL. There is some political color behind this PIL.’ The court was hearing the petition of advocate S Pal Singh, in which it was requested to ban the disclosure of the identity of the victim by the media in the case of assault on Maliwal and to take action against those who deliberately revealed the identity of the victim along with the contents of the FIR.
‘You are doing it for publicity’
The bench warned the lawyer that a complaint would be filed against him in the ‘Bar Council’. It said that the petition was filed without doing enough research. The bench said, ‘You are doing all this for publicity. A complaint should be filed in the ‘Delhi Bar Council’. What you are doing is not proper.’ After this, the petitioner’s lawyer sought permission to withdraw the petition. The High Court said, ‘After presenting some arguments, the petitioner’s lawyer expressed his desire to withdraw the petition. The petition is dismissed due to withdrawal.’ Bibhav Kumar is in custody in connection with the alleged attack on Maliwal at the Chief Minister’s residence earlier this month.
