The Calcutta High Court recently observed that the use of ‘sweetie’ and ‘baby’ to address women is prevalent in certain social circles and the use of these terms may not always reflect sexual harassment.
In the same judgment, the Court also warned that if the provisions of the Prevention of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act (POSH Act) are misused, it would create more hurdles for women. A woman employee of the Coast Guard had alleged that her superior had sexually harassed her in various ways, including using the words ‘sweetie’ and ‘baby’ to address her. The complainant argued that there were sexual innuendoes in the statements of the senior officer.
However, the senior officer said that he never used these words in a sexual manner. He said that when the complainant expressed his problems, he stopped using such words. The High Court acknowledged that the use of such words was considered inappropriate by the Internal Complaints Committee (ICC), but also said that the use of such words is not always associated with harassment of women.
