New Delhi. The matter of taking over Shiv Sena in Maharashtra is now in the Supreme Court. The Supreme Court will hear this matter tomorrow i.e. Wednesday at 3.30 pm. Uddhav Thackeray group’s lawyer and MP Kapil Sibal mentioned the matter before the bench of Chief Justice DY Chandrachud in the Supreme Court. Sibal requested for an immediate stay in the matter. He told the Supreme Court that the Eknath Shinde faction has already occupied the office of the Uddhav faction. If the hearing is not done immediately, other things including the bank account will also be taken away. After this argument of Sibal, the Supreme Court said that the hearing will be held on Wednesday.
Kapil Sibal also told the court that the Election Commission has given the decision to give Shiv Sena’s name and bow and arrow election symbol to Eknath Shinde on the basis of 33 members of the assembly. However, in the decision taken by the Election Commission in this regard, it was told that apart from 40 MLAs, there are 13 Shiv Sena MPs along with the Shinde faction. Now the Supreme Court will see tomorrow whether there is anything wrong with the Election Commission’s decision regarding Shiv Sena. It is believed that at present the court can give a stay in this matter.
On the issue of occupation of Shiv Sena, hearing is already going on in the Supreme Court on a separate application of the Uddhav faction. This hearing is being conducted by a constitution bench of 5 judges headed by the Chief Justice. The Nabam Rebia issue has been raised by the Eknath Shinde faction. In this matter, the Constitution Bench of the Supreme Court had earlier ruled that if the Speaker of the Legislative Assembly is given a notice to remove him, he cannot take any decision on the disqualification of the MLAs. The Uddhav group had challenged the Rebia verdict itself. After hearing on this, the Supreme Court had decided not to send the matter to a larger bench of 7 judges.
