New Delhi: The petition of Delhi Chief Minister Arvind Kejriwal in the Delhi Excise Policy scam case is being heard in the Supreme Court today i.e. on Tuesday. In some time, the decision of the Supreme Court will decide whether Arvind Kejriwal will get interim bail today or not. Before giving its decision regarding granting interim bail to Arvind Kejriwal in the money laundering case related to excise policy, the Supreme Court remarked that there is an extraordinary situation because Lok Sabha elections are being held.
The bench of Justice Sanjiv Khanna and Justice Dipankar Dutta said that Arvind Kejriwal is not a habitual criminal. He said, ‘He is the Chief Minister of Delhi and an elected leader. Elections are taking place. This is an extraordinary situation. It is not that he is a habitual criminal. We will consider hearing arguments about whether he should be released on interim bail or not. The top court told senior advocate Abhishek Singhvi, appearing for Chief Minister Arvind Kejriwal, that the court does not want him to do government work after getting interim bail.

The bench said, ‘If you do government work, it will be a conflict of interest and we do not want that.’ Singhvi assured the bench that if Arvind Kejriwal gets interim bail in the case, he will not see any file related to the excise policy scam. After this, ED opposed the opinion of the apex court to hear the interim bail for Arvind Kejriwal and said that the court cannot create a separate category for leaders.

Solicitor General Tushar Mehta said on behalf of ED, ‘At present around 5,000 cases related to MPs are pending in the country. Will all of them be released on bail? Is a farmer less important than a leader for whom it is the season of harvesting and sowing of crops?’ SG Tushar Mehta said that if Arvind Kejriwal had cooperated in the investigation, he would not have been arrested, but he ignored nine summons.
He said that this impression is being created with great success that Arvind Kejriwal has not done anything but he has been arrested just before the elections. Arvind Kejriwal was arrested in this case on March 21 and is lodged in Tihar Jail in judicial custody. The apex court had issued a notice to ED on April 15 and sought its response on Kejriwal’s petition against his arrest. On April 9, the Delhi High Court had upheld Kejriwal’s arrest, saying there was nothing illegal in it and the ED was left with very few options after Kejriwal repeatedly ignored the summons.
