Swati Maliwal has alleged that Bibhav Kumar assaulted her in CM Arvind Kejriwal’s official residence. He broke the buttons of her shirt and threw her on the ground. On this, Delhi Police has imposed IPC sections 308, 354B, 506 and 509 on Bibhav Kumar. Let us tell you how the crime is described in these sections. Under section 308 of IPC, 7 years of imprisonment and fine is imposed. 308 is imposed when any person acts with such an intention that someone may die. At the same time, under section 354B of IPC, there is a punishment of 3 to 7 years. It includes attack with the intention of disrobing a woman.
Under Section 506 of IPC, Bibhav Kumar, accused of assaulting Swati Maliwal, is liable for 2 years imprisonment and fine. It is a case of threatening to harm someone’s life, property or family. Whereas, under Section 509 of IPC, there is a provision of maximum punishment of 3 years and fine. Section 509 of IPC applies for using indecent words for a woman, making obscene gestures and trying to outrage the modesty of a woman with criminal intent. Let us tell you that Bibhav Kumar has denied all the allegations made by Swati Maliwal. At the same time, Aam Aadmi Party leader and minister in Arvind Kejriwal’s government Atishi had alleged that Swati Maliwal tried to trap the Delhi CM at the behest of BJP, but when she failed, she trapped Bibhav Kumar. Whereas, earlier Aam Aadmi Party MP Sanjay Singh had given a statement that Bibhav Kumar had misbehaved with Swati Maliwal and Arvind Kejriwal is going to take strict action in this matter.
