New Delhi: The Supreme Court has approved the Rajasthan government’s two-child rule. The Supreme Court has upheld the Rajasthan government’s rule of not giving government jobs if there are more than two children. The Supreme Court said that this rule comes within the scope of policy and there is no need to interfere in it. The Supreme Court said that refusing to give government job if there are more than two children is non-discriminatory. The objective behind the provision is to promote family planning.
Let us tell you that the Supreme Court had given green signal to a similar rule for contesting Panchayat elections. The Supreme Court said that this rule comes within the scope of policy and there is no need to interfere in it. A bench of Justice Surya Kant, Justice Dipankar Dutta and Justice KV Vishwanathan upheld the decision of the Rajasthan High Court dated October 12, 2022 and dismissed the petition of former soldier Ramji Lal Jat.
In fact, after retirement from defense services on January 31, 2017, Ramjilal Jat had applied for the post of Rajasthan Police Constable in Rajasthan Police on May 25, 2018. Her candidature was rejected under Rule 24(4) of the Rajasthan Police Subordinate Service Rules, 1989 on the ground that since she had more than two children after 01 June 2002, she was ineligible for government employment.
These rules state that no candidate will be eligible for appointment to the service who has more than two children on or after 01 June 2002. The court said that it is undisputed that the appellant had applied for recruitment to the post of constable in Rajasthan Police and such recruitment is governed by the Rajasthan Police Subordinate Services Rules, 1989. The bench said that a similar provision was introduced as an eligibility condition for contesting panchayat elections, which was upheld by the Supreme Court.
The court had then held that the classification, which disqualifies candidates if they have more than two living children, is non-discriminatory and outside the scope of the Constitution. Because the purpose behind the provision is to promote family planning.
