The Supreme Court on Thursday upheld the ban on demolition of bulldozers in Delhi’s Jahangirpuri for the time being. The next hearing of this matter will be after two weeks and till then no construction will be demolished here. Advocate Kapil Sibal, who filed the petition on behalf of Jamiat Ulema-e-Hind, also put a demand before the court during the hearing that the sabotage by bulldozers should be banned across the country. However, the court rejected this appeal.
Kapil Sibal called the action of bulldozers against a religion and demanded from the Supreme Court that the demolition should be stayed. Justice J Rao said that a stay cannot be imposed on demolition across the country. To this Sibal said that sabotage by bulldozers like this should be stopped. Justice Rao replied that demolition is done only by bulldozer.
Kapil Sibal said in the court that encroachment is wrong. But Muslims are being linked with encroachment. On this argument of Sibal, Justice Rao questioned whether the property of any Hindu was not broken? After this Sibal also said that he has some pictures where houses of people of a community were vandalized. Encroachment cannot be linked to a single community. The encroachment is not limited to any A or B community. You cannot demolish houses simply by saying encroachment.
It is worth noting that after stone pelting on the procession on the occasion of Hanuman Jayanti in Jahangirpuri, the Municipal Corporation on Wednesday ran a bulldozer on illegal construction here. By filing a petition in the Supreme Court against the action, Jamiat Ulema-e-Hind claimed that this action has been taken without notice. However, Solicitor General Tushar Mehta said in the court that this action was already going on and notice had been given to all.
