A Mumbai court has acquitted a man on the promise of marriage in a rape case on the issue, saying sending “obscene messages to a woman” before marriage cannot be an insult to one’s dignity. A sessions court in Mumbai has ruled that such messages sent to fiancee before marriage can be considered as a symbolic medium to show each other’s feelings and love.
Let us tell you, a complaint was lodged against a 36-year-old man accusing his fiancé of raping him 11 years ago on the pretext of marriage. Hearing this matter, the Court observed that if a person does not like the other, then he has the right to express his displeasure against him and the other party should avoid such mistake. However, the purpose of these messages can be to express one’s desires to the fiancé, to arouse the feeling of sex, etc. In such a situation, it cannot be said that such SMS hurts the dignity of the woman who is going to get married.
It is worth mentioning that the woman had lodged a complaint against a man in 2010. The two met in 2007 at a matrimonial site. The young man’s mother was against the marriage. The young man ended his relationship with the girl in 2010. The court acquitted the youth saying that turning away from the promise of marriage cannot amount to cheating or rape. The court said in its decision that the youth had gone to an Arya Samaj hall with a mangalsutra. But due to circumstances and respecting his mother’s wish, he withdrew his decision and surrendered to his mother. The young man could not convince his mother for this marriage and as such it cannot be considered a case of false promise of marriage.
