A special court hearing cases related to the Central Bureau of Investigation (CBI) has refused to grant bail to Sandeep Ghosh, former principal of Kolkata-based RG Kar Medical College and Hospital. Along with this, the court said that there are serious allegations against Sandeep Ghosh which, if proved, can even lead to death sentence.
On August 9, the CBI had arrested Ghosh and former in-charge of Tala police station Abhijit Mondal on charges of tampering of evidence and delay in filing the FIR in the case of alleged rape and murder of a doctor in a government hospital. The court, in its order pronounced on September 25, said that from the case diary it appears that the investigation process by the Central Investigation Agency is in full swing.
Rejecting Ghosh’s bail plea, Additional Chief Judicial Magistrate S Dey said the allegations were of serious nature and if proved, could attract death penalty, which is awarded in the rarest of rare cases. The judge said that the court is of the opinion that releasing the accused on bail would be a violation of the principle of equity. He said in the order that a person can commit a crime with the help of others and there is no need for the other accused to be present at the scene of the incident.
The court also rejected the bail plea of Abhijeet Mandal. It accepted the CBI’s request to send both the accused to judicial custody till September 30. Ghosh’s lawyer claimed before the judge at the Sealdah court here that he was falsely implicated in the case and had no role in the crime as alleged.
