The decision regarding this has been given by the Supreme Court. The Supreme Court has said in its decision that the executive cannot hold any person guilty, nor can it become a judge who decides to demolish the property of an accused.
Along with this, the Supreme Court said that if a crime is proven against a person. After that his house is demolished. So this is also wrong. It would be legal for government officials to do so. And by doing so the executive would be taking the law into its own hands. The court said that having a home is the fundamental right of everyone. Along with this, the court said that someone’s house cannot be demolished unless notice is given 15 days in advance.
If action has to be taken on any house, then a notice will be sent by the authorities to the owner of that house 15 days in advance through registered post. And that notice will also be pasted outside that house. Besides, he will also have to explain in the notice why the house is illegal. Which rules have been violated? If any of these guidelines are violated then it will be contempt of court.
