Washington: The lawyer of Mumbai attack convict Tahawwur Rana has urged the US Supreme Court to review the lower court’s decision to extradite him to India. The lawyer has cited the ‘principle of double jeopardy’, which prevents a person from being tried or punished twice for the same crime. India is seeking the extradition of Rana, a Canadian citizen of Pakistani origin, as he is wanted in the 2008 Mumbai terror attacks case.

Rana lost the legal battle

After losing the legal battle in lower courts and several federal courts, including the US Court of Appeals for the Northern Circuit in San Francisco, Rana had filed a petition before the US Supreme Court on November 13. U.S. Solicitor General Elizabeth B. Preloger urged the Supreme Court on December 16 to dismiss the petition. Rana’s lawyer Joshua L Dratel, in his reply on December 23, challenged the US government’s recommendation and requested the court to accept his plea.

This is the last chance

In a protracted legal battle, this is Rana’s last legal chance to avoid being extradited to India. The court has scheduled a hearing for both sides on the issue for January 17. Rana, currently lodged in a Los Angeles jail, is accused of being involved in the conspiracy of Mumbai attacks. He is believed to be linked to Pakistani-American terrorist David Coleman Headley, one of the key conspirators of the 26/11 Mumbai attacks. (Language)
