Maulana Madani
New Delhi: The Uniform Civil Code (UCC) has been implemented in Uttarakhand in January. Jamiat Ulama-e-Hind President Maulana Arshad Madni filed a petition in the Nainital High Court today and mentioned it before the Chief Justice of Uttarakhand on the instructions of Maulana Arshad Madni, President of Jamiat Ulama-e-Hind. The court can hear the matter this week. Senior Supreme Court advocate Kapil Sibal Jamiat will be advocated by Ulama-e-Hind in the court.
What did Maulana Madani say?
Maulana Madani reacted to this petition, saying that Jamiat Ulama-e-Hind has approached the court with the hope that we will get justice to maintain the rule of the constitution, democracy and law of the country. Because the court is the last support for us. He said that we do not accept any law against Sharia, Muslims can compromise everything but cannot compromise our Sharia and religion. This is not a question of existence of Muslims but a question of their rights.
Maulana Madani said that by bringing the uniform civil code law, the current government wants to take away the rights given by the Constitution of the country to the existing government. Because according to our faith, the religious law that is our religious law is not by any human but by the Quran Hadith. For those who do not want to implement any religious personal law, there is already an alternative civil code for those people in the country, then what is the need of the Uniform Civil Code?
He said that implementing the Uniform Civil Code is contrary to the fundamental rights given to citizens in the Constitution. Maulana Madani said that the question is not about the personal law of Muslims but to maintain the secular constitution of the country in its current position. Because India is a secular country and secularism in the Constitution means that the government of the country has no religion of its own and the people of the country are free to follow their religion, so uniform civil code is unacceptable for Muslims and the country It is also harmful for unity and integrity.
No state has the right to create an uniform civil code: Madani
He further said that Article 44 is presented as evidence to implement the Uniform Civil Code and it is propagated that the Uniform Civil Code is mentioned in the Constitution, while Article 44 is not in the guide principles, but one The advice is, but there is no mention of Articles 25, 26 and 29 of the Constitution, which recognize the fundamental rights of citizens and guarantee religious freedom and also provided security by Muslim Personal Law Shariat Application Act, 1937 She goes. Anyway, no state has the right to create an uniform civil code.
Madani said that in this way, the Uniform Civil Code violates fundamental rights. Despite this, our government says that there will be a law in one country and one House cannot have two laws. It is strange and bizarre. Maulana Madani also said that the provisions of IPC, CRPC are not the same in the whole country. Their form changes in states. There is not a law on cow slaughter in the country. The law that is not applicable in five states.
Maulana Madani said that whenever the communal powers tried to intervene in Sharia law before and after independence, Jamiat Ulama-e-Hind has fought against it with full force, the history of India is witness to this. That whenever the Government of India felt the need to enact a law in relation to Sharia, that law could not be completed without the guidance of Jamiat Ulama-e-Hind. For example, cancellation of Sharia law and marriage, there are many documents in India’s law which mentions the name and its efforts of Jamiat Ulama-e-Hind.
Communal forces want to keep Muslims in constant fear and chaos: Madani
Maulana Madani also said that it seems right to say that implementing the Uniform Civil Code is a well-planned conspiracy to limit the religious freedom of citizens. She also said that communal forces raise new emotional and religious issues and want to keep the minorities of the country, especially Muslims in constant fear and anarchy and want to set the country’s constitution on fire, but Muslims want to fire any kind and anarchy. Should not be a victim of As long as there will be justice-seemed people in the country, Jamiat Ulama-e-Hind will continue its fight against these forces, which is not only a big threat to the unity and integrity of the country, but also share the society on the basis of hatred They are also trying He said that the yeast of this country includes love for thousands of years, but love. For some time, hatred can be called successful, but we are sure that the last and decisive victory will be of love.
