New Delhi. The next Chief Justice of the Supreme Court, BR, on the petitions filed against the Waqf Amendment Act. The bench headed by Gawai will hear. Actually, the case was to be heard in the Supreme Court today, but Chief Justice Sanjeev Khanna said that there is a need to hear in detail, now that CJI Khanna is retiring on May 13, he fixed the date of May 15 for hearing the case. The new Chief Justice Justice Gawai will hear the case a day after taking oath on 14 May.
Justice Sanjeev Khanna said that in this case, everyone’s point will have to be listened and he does not want to keep any order safe on the petitions challenging the validity of the Waqf Amendment Act. Justice Khanna said, the case should be heard soon but it will not be in front of me and with this he transferred the case near the new bench. The CJI said that we have not considered the counter -affidavit of the Center very deeply at the moment. There is a need to consider the points raised by the Center in relation to Waqf properties and the disputed figures given by the Center.
Earlier, the Central Government had said in its counter -affidavit in the court that all petitions filed against the Waqf Amendment Act should be dismissed. The government has argued that on the basis of intensive study, analysis, the amendment in the Waqf has been taken to take the opinion of all parties and the amendment has been finalized after considering their objections. The government said that the court does not have the right to stay directly or indirectly on the legal provisions of the law.
