Jaipur. Rajasthan Real Estate Regulatory Authority (RERA) has given compensation to a customer to Jaipur Dream Buildcon Private Limited Builder Order Has given. Luna Raj lodged a complaint against the builder in the court. The complainant had alleged that the builder asked for money in installments, but did not start construction of the flat. This caused them financial and mental trouble. He sought compensation from the court for financial loss, mental pain and legal expenses.
The builder said in the court that the complainant has not given any account of the compensation amount nor has any special reason. The builder also said that the RERA Authority had already ordered the complainant to withdraw Rs 4,05,968 with interest, which has been paid. The builder alleged that the complainant was complaining with the wrong intention.
The complainant told the court that he had deposited Rs 4,05,698 for the flat, which was more than 10% of the total price, but the builder did not compromise with him. He said that the builder has returned the money with interest to them, but they should also get compensation for mental problems and other losses. The court, after listening to both the parties, ruled that the complainant should get compensation. The court admitted that the builder did not build a flat on time and caused mental and physical pain to the complainant.
RERA’s Adjucting Officer R. S. After hearing, Kulhari ordered the builder to give a compensation of Rs 20,000 to the complainant for mental pain and Rs 10,000 for legal expenses. The court also said that if the builder does not follow this order within 45 days, he will also have to pay interest to the complainant at the rate of 6% per year.
