The Supreme Court on Thursday agreed to hear the petition filed against the proposal to demolish alleged illegal properties in Jamia Nagar in the national capital next week.
Chief Justice B.K. R. A bench of Gawai and Justice Augustine George Christ initially asked the lawyer to knock the Delhi High Court against the demolition notice issued by the Municipal Corporation officials.
The Chief Justice said, “Go to the High Court.”
The lawyer said that there is an order of this court that it is necessary to give notice 15 days in advance.
The lawyer said, “But the notice has been pasted, on which it is written that we have to vacate the assets. The notice was pasted on 26 May.”
He said that there was no hearing.
The lawyer said, “If there is a hearing, we can get some support.”
The bench then agreed to list the petition next week.
Recently, the authorities have issued notices to demolish several houses in Jamia Nagar area of Okhla, Delhi, citing encroachment on the land of Uttar Pradesh Irrigation Department.
The May 22 notice stuck on the respective properties stated, “All are informed that Okhla, Khizarbaba Colony, belonging to the Irrigation Control Department of Uttar Pradesh, has been encroached in the Khizarbaba Colony. The houses and shops on this land are illegal and will be removed in the next 15 days.”
The step has been taken following the direction of the Supreme Court of May 8, in which the Delhi Development Authority (DDA) was asked to demolish unauthorized structures as per law in Okhla village.
