Kolkata. The Calcutta High Court converted Suresh Paswan’s death sentence to life imprisonment for rape and killing a 2.5 -year -old girl. Calcutta High Court Justice Debangshu Basak and Justice Shabbar Rashidi did not find the case of rape and murder of the girl in the category of rarest of the rare. The trial court sentenced Suresh Paswan, convicted of the brutal behavior of the girl. The incident took place in Khidirpur area of Kolkata. The girl slept under a flyover with her family. When Suresh Paswan picked him up and murdered after the rape.
A bench of the Calcutta High Court said that the situation of rape and murder of the girl did not show whether it was already planned or an old rivalry between the victim’s family and the convict. The High Court said that the Supreme Court has considered all such cases disgusting, but the death sentence is not accepted right. The bench said that we do not find that the case falls under the category of rarest of the rare and should be punished. The court said that due to this the convict is sentenced to life imprisonment. Seeing the age of the victim, the bench of the Calcutta High Court said that the convict would have to stay in jail at least 50 years. After which he will be able to appeal to the punishment.
Witnesses in the incident of rape and murder of the girl told the trial court that the convict was seen walking around the victim’s place of stay on the day of the incident. The girl was missing the same day. On the same day, at around 1 o’clock in the night, the witnesses saw Suresh Paswan carrying the girl on her lap. The convict Suresh Paswan used to work as a horses at Kolkata Royal Turf Club. He was accused of kidnapping, raping and killing the child. He appealed to the Calcutta High Court on the death sentence.
