Amid busy discussion between the two houses of Parliament, Chairman Om Birla may announce the formation of an inquiry committee to investigate the basis of the allegations against Judge Yashwant Verma of the Allahabad High Court.
Sources said that the notice signed by 152 MPs assigned to Birla on July 21 is now the “property of the House” and consultation for the formation of a three -member committee has started, either the Chief Justice of India or the Supreme Court Judge, the Chief Justice of a High Court and a reputed jurist.
Since the same notice signed by 63 opposition MPs on the same day was handed over to the then Rajya Sabha Chairman Jagdeep Dhankhar, the upper house is also part of the counseling process.
As a part of this process, the Speaker is expected to write a letter to the Chief Justice seeking a recommendation of the names of two judges, while the selection of the prestigious jurist is his privilege.
Since the notice was submitted, Home Minister Amit Shah, House leader JP Nadda, Chairman Birla and Rajya Sabha Deputy Chairman Harivansh, who are now in charge after the resignation of Dhankhar, have been part of future action.
Dhankhar on Monday, citing the Judge (Investigation) Act in the Rajya Sabha, said that when a notice of the proposal is submitted on the same day in both houses of Parliament, a committee would be set up by the Lok Sabha Speaker and the Rajya Sabha Chairman to investigate the allegations against the judge.
In dramatic developments, he resigned in the evening to “give priority to health care”, while there were clear indications that the government was angry with the opposition to receive notices sponsored and mention it in the House, while the bipartine notice was already submitted to the Lok Sabha Speaker.
Now that Harivansh is in the post of president in the Upper House, one of those who signed the notice said that now the Chairman has to decide on it. He further said, “We have not been told anything yet.”
The Act states that the three -member committee will “check the grounds on which a judge has been requested to remove”.
