The appellate tribunal NCLAT on Thursday accepted the petitions filed by Meta Platforms and WhatsApp against the fine imposed by the fair trade regulator, Competition Commission of India (CCI). According to PTI news, CCI had imposed a fine of Rs 213.14 crore on the company for abuse of market dominance. According to PTI news, after hearing the initial arguments of Meta and CCI on the issue, a two-member bench of the National Company Law Appellate Tribunal (NCLAT) said that the issue needs to be considered.
Decision will be taken next week
According to the news, the NCLAT bench, which also included its Chairman Justice Ashok Bhushan, said that we accept both the appeals. However, on the interim relief of staying the CCI order, NCLAT said it will decide next week. During the proceedings, the counsel appearing for WhatsApp and Meta platforms requested the appellate tribunal to stay the CCI order. However, the counsel appearing for the Competition Commission of India opposed this.

On November 18, the Competition Commission of India (CCI) had imposed a fine of Rs 213.14 crore on social media major Meta for unfair business practices in connection with the WhatsApp privacy policy update made in 2021. Furthermore, the competition regulator directed Meta to cease and desist from anti-competitive practices. According to the CCI order, Meta and WhatsApp have also been asked to implement certain corrective measures within a stipulated time frame to address anti-competitive issues.
No condition will be made for users
CCI has called upon WhatsApp to implement various remedial measures, including barring WhatsApp from sharing data collected on its platform with other meta companies or meta company products for advertising purposes for five years. Apart from the rest of the directions, the CCI has said that sharing user data stored on WhatsApp with other meta companies or meta company products for purposes other than providing WhatsApp services will hamper the ability of users to access WhatsApp services in India. No condition will be made for this.
