Recently, a case came before the Madhya Pradesh High Court in which the wife alleged that her husband is violent towards her and also demands Rs 25 lakh as dowry. On the other hand, the husband alleged that his wife used to talk obscenely with his male friends on a mobile phone. The Madhya Pradesh High Court recently dismissed a woman’s appeal, in which the family court approved her divorce petition on the basis of cruelty to her husband.
The husband alleged that his wife used to talk to his male friends about his personal life and his wife also talked to his male friends about the physical relationship between husband and wife over the phone. A bench of Justice Vivek Rusia and Justice Gajendra Singh ruled in this regard.
What did the court say?
The court said that after marriage, neither wife nor husband will be able to have obscene conversation with their friends. The court said that no husband will tolerate his wife by talking obscenely on mobile phones. After marriage, the husband and wife have the freedom to talk to anyone on the phone, but they should take care of what kind of conversation they are.
The court said, the level of your speech should be civilized. The court further said that when you are talking to a man while being a woman or when you are talking to a woman while being a man, then your level of conversation should be more civilized. Your words should be such that your partner has no objection to them. The court said that if the husband or wife continue to say such things despite objecting, then it will definitely bring mental cruelty to another spouse.
How did a quarrel begin between the couple?
The couple was married in 2018. The husband is partially deaf and this information was given to the wife before marriage. However, the husband alleged that soon after marriage, the wife started abusing her mother and left in -laws after a month and a half. The husband has also alleged that after marriage his wife used to chat with her old lover on a mobile phone. The husband said that the conversation between them on WhatsApp was obscene.
The wife, while putting her side on the allegations made by her husband, said that she has no connection with the person who is accused of chatting. She also claimed that her husband hacked her mobile phone and sent messages to two people to prepare evidence against her.
What did the wife say?
The wife further argued that her husband had violated her right to privacy by deleting the chat from her phone. The wife has also accused her husband of assaulting and demanding dowry of Rs 25 lakh. However, the High Court found that the woman’s father himself admitted that her daughter had a habit of talking to male friends.
The Family Court found that the appellant’s interactions with others and the printouts of the jokes, examples A/4 and A/6, were not decent interactions. No ventilative action has been taken against the defendant through FIR or complaint of domestic violence etc., which proves that the allegations of the defendant against the wife are true. Because of this, the court completely agreed with the family court’s decision to divorce the person.
