Patna High Court has given a big decision in the case of deaths due to falling from trains. This order will provide great relief to the common people. The court has ordered to give compensation of eight lakh rupees in such cases. The court said that in no case compensation less than eight lakh rupees will be given. A single bench of Justice Sunil Dutt Mishra gave this order after hearing the petition filed by Shatrughan Sahu. Incidents of death due to falling from trains are frequent in Bihar.
Citing the gazette notification issued by the Railway Ministry on 22 December 2016, the court said that to end the confusion arising regarding compensation, the compensation amount has been increased to eight lakh rupees. The court amended the Railway Claims Tribunal order and said that if the compensation amount including interest is less than Rs 8 lakh, then it will have to pay a compensation of at least eight lakh rupees. The court was told that the applicant’s son had bought a second class ticket for train number 53608 to go to Gaya Junction on June 1, 2014. He boarded the train after buying a ticket from Anugrah Narayan Road Railway Station, but due to the jostling of the passengers, he fell from the moving train. Bipul Saav was seriously injured due to falling from the train. He was brought to Sadar Hospital Anugrah Narayan for treatment, where he died during treatment.

The father of the deceased filed a case in the Railway Claims Tribunal in Patna for compensation. The tribunal ordered compensation of Rs 4 lakh on the death of the applicant’s unmarried son with 12 percent annual simple interest. On this order, the railway filed a review petition and challenged the interest. The tribunal amended its earlier decision and ordered 6 percent simple interest, which the applicant challenged in the High Court. The court gave this decision after hearing the arguments presented by the applicant and the railways.
