Politics has heated up over the move to nominate 5 MLAs before government formation in Jammu and Kashmir. This is being strongly opposed by the Congress. He termed any such decision as an attack on the basic principles of democracy and the Constitution. According to reports, for the first time in Jammu and Kashmir, five nominated MLAs will play an important role in the formation of the new government. Elections have been held in the Union Territory after a gap of a decade. The Lieutenant Governor will nominate these members on the basis of the advice of the Home Ministry.
This process was started after the Jammu and Kashmir Reorganization Act 2019 was amended last year on July 26, 2023. After the nomination of 5 MLAs, the number of members of Jammu and Kashmir Assembly will increase to 95, taking the majority mark to form the government to 48. Ravindra Sharma, senior vice president and chief spokesperson of Jammu and Kashmir Pradesh Congress Committee (JKPCC), said, ‘We oppose the nomination of five MLAs by the Lieutenant Governor before the formation of the government in Jammu and Kashmir. Any such step is tantamount to attacking the basic principles of democracy, mandate and Constitution.
‘Misusing the provision of nomination is harmful’
The Congress leader expressed his disagreement and protest on this issue. Also announced to fight it boldly. Party leader Raman Bhalla was also present during this period. Sharma said, ‘According to the Constitution, the Lieutenant Governor should act on the advice of the Council of Ministers. It would be harmful to misuse the provision of nomination to change the position of majority or minority after the elections. He said that as per the Jammu and Kashmir Reorganization Act, the Lieutenant Governor has the authority to nominate 5 MLAs, including Kashmiri Pandits and refugees from Pakistan-occupied Jammu and Kashmir (PoK).
