Kolkata, October 6 (IANS). In a specially convened hearing on Sunday into the case of alleged rape and murder of a minor girl in Jaynagar in West Bengal’s South 24 Parganas district, the Calcutta High Court ordered that the post-mortem of the victim’s body be sent to a judicial magistrate at a centrally run hospital in the state. This should be done in the presence of a magistrate.
A single bench of Justice Tirthankar Ghosh told Calcutta High Court Chief Justice T.S. Following the directions of Shiva Gananam, the case was heard on emergency basis and directed that the judicial inquiry into the case be conducted at the All India Institute of Medical Sciences (AIIMS), Kalyani in Nadia district in the presence of a Judicial Magistrate.
If AIIMS Kalyani does not have the requisite infrastructure for autopsies, Justice Ghosh directed that the autopsies should be conducted at the Government College of Medicine and JNM Hospital, located in the same district. However, he said that even if the autopsy is conducted at the government college, it should be done by a forensic medicine expert from AIIMS Kalyani and no one from JNM will be allowed to be present at the time of the autopsy.
Further, while directing video recording of the entire post-mortem process, Justice Ghosh said that the parents of the deceased should be allowed to be present outside the post-mortem room and if they wish, they should be allowed to watch a video recording of the post-mortem. Copy should be provided.
Meanwhile, on Sunday, state BJP secretary Priyanka Tibrewal wrote a letter to NCPCR national president Priyank Kanungo seeking the commission’s intervention in the matter.
She said in the letter, “I urge the National Commission for Protection of Child Rights (NCPCR) to take action in this matter with utmost urgency. Your intervention in this matter will be important in confirming that the safety and rights of our children must remain a priority.” Such heinous acts will not be tolerated and justice will be provided to the victims.”
In his letter, Tibrewal has also stressed that the involvement of the Central Bureau of Investigation (CBI) is essential to guarantee a fair and thorough investigation of this heinous crime.
The letter said, “Such intervention is necessary not only to preserve the sanctity of the legal process but also to restore public confidence in the administration of justice, thereby ensuring that the investigation is free from any local bias or unfairness.” Be free from influence.”
